The lack of a fixed address and 28 previous convictions worked against an accused thief in his request for bail in the No. 1 District ‘A’ Magistrates’ Court.
Kishmar Decarlos Hall, 35, was remanded to Dodds Prison after standing before Chief Magistrate Ian Weekes and pleading not guilty to four theft charges.
He denied that between December 31, 2024 and January 5, this year, having entered the dwelling house of Mark Thorne as a trespasser, he stole a tent, powder coating machine, a gas bottle, a saw, a makeup bag, a wheelbarrow, a rake and other items valuing $8 020, belonging to Tata’s and Sons Company Limited; and on April 15, having entered Biso’s Fruits and Vegetables Wholesale as a trespasser, he stole one cash register, a cheque and money, with a total value of $2 350.10, belonging to Trishwatie Singh-Jairam.
Hall also pleaded not guilty to a charge of stealing metal shears, valued $50, belonging to Ryan Gittens on May 6; and a fourth charge of stealing steel bars valued at $408.24, belonging to Bisram Singh on May 7.
Court prosecutor Sergeant Randolph Boyce objected to bail due to the accused’s antecedents, the lack of a fixed place of abode on his charge sheet, and the number of allegations levelled against him.
“In the interest of public order, public safety and security, we do not feel that he should get bail. Due to his lack of address, he may not turn up for trial,” the prosecutor said. “Two of these matters are against the business community, and when the business community suffers these types of losses, it impacts not only their ability to run their business but impacts on their ability to maintain employment. In addition, he has 28 previous convictions, several of which are of a similar nature, and the evidence in these matters is strong.”
Insisting that he lived with his girlfriend in Goodland, St Michael, Hall told the court that he was innocent.
“I cannot plead guilty on things that I have not done. You know me, Sir, I do not waste the court’s time. I would come and throw in my belt when I wrong, but I cannot throw in my belt for things I ain’t do,” he stated.
Hall will return to court on June 6.
